Terms and Conditions

  1. GENERAL

Terms of Trade

These terms and conditions govern the supply of Enviro Tools Limited products. By ordering our products you accept these terms. Unless we have entered in to a separate contract with you, or have otherwise agreed specifically in writing, these terms and conditions override any other contradicting communication or agreement.

Enviro Tools Limited undertakes to meet all applicable conditions under the Fair Trading Act 1986 and Consumer Guarantees Act 1993.

References to “we”, “us” and “our” are to Enviro Tools Limited.  References to “you” and “your” are to the person recorded as the customer (also known as the buyer or purchaser) when placing the order for products.

The Terms and Conditions as contained in this document and any liability arising from the supply of products to you applies only to customers located in New Zealand.  If delivery is made to you outside of New Zealand, these Terms and Conditions do not apply and the specific Terms and Conditions of our individual contract with you will apply to the supply of our products.

Any agreement between us is governed by the laws of New Zealand. Any dispute is subject to the non-exclusive jurisdiction of the New Zealand courts.

Acceptance of Orders

We are not obliged to accept any order. If for any reason we decide not to accept your order, we will notify you as soon as is reasonably practicable and refund to you any payment received in full.

  1. LIABILITY

Our products are sold to you on the understanding that you have the ultimate responsibility for determining their suitability for the purposes of which you intend to use them.

Our liability to you for any loss or damage suffered by you as a result of you using our products, us breaching our obligations under these terms, or any other legal duty relating to the products (including arising by reason of defects in the Products) is limited to a repair, replacement or refund of the relevant products.

We will not be liable to you for any loss of profits, opportunity, business or contract, any indirect or consequential loss, or any exemplary, incidental, special or punitive damages, arising from or in connection with these terms or any products.

Except as stated in these terms and conditions, we give no further warranty in respect of our products.

The limitations and exclusions under this heading apply to all liability (including for negligence), regardless of the legal basis of the claim, but only to the extent permitted by law.


 

  1. PERSONAL INFORMATION

Any personal information collected, and that you supply to us in relation to your order or specific inquiry will be used for administration, service, security, and credit purposes. Personal information may also be used for marketing purposes, except where you have specifically requested otherwise.

You have the right of access to, and to ask for correction of, your personal information.

We will not sell, exchange, or otherwise distribute your personal information to a third party without your prior written consent.

  1. PAYMENTS AND PROPERTY

Unless we have agreed in writing to extend credit to you, you must pay for your order in full before delivery or collection. The decision to extend credit is made by us and is at our full discretion.

Where we have agreed in writing to extend credit to you, the specific payment terms, including payment due date, which is applicable to the sale will be outlined in the supplied invoice. Where payment terms stipulate a deposit or partial payment amount, this must be paid in full before delivery or collection. Any remaining amount owing must be paid in full in accordance with the payment terms.

Property and ownership of products supplied will not pass to you until we receive payment in full for the purchase price of the products. Payments which you make to us will be applied first to any amount owing.

  1. WARRANTY

Terms of Warranty

We provide a 5-year full manufacturer’s warranty on our range of trapping products.  

This warranty covers any damage, faults or defects resulting specifically from manufacturing and assembly error which renders the product partially or fully incapable of functioning as intended, or where product aesthetics are compromised beyond that which can be considered reasonable.

This warranty offers you the choice between a replacement of the same product, or a refund of the original purchase value of the product.

Warranty Exclusions

While our products are engineered to be durable and robust, there are certain things out of our control which we cannot provide a warranty against. We exclude any product that:

  • has been purchased more than 5 years ago or,
  • you or a third party have modified, tampered with, misused or abused or,
  • has been installed or operated in a manner contrary to the instructions provided with the product or,
  • otherwise has been damaged as a result of causes beyond our reasonable control. This includes damages caused by animal interaction such as biting or chewing of components or,
  • is a consumable product such as bait.

Although excluded from our warranty, we may be able to provide repair or replacement parts to you at a minimal cost. Please contact us at: sales@envirotools.co.nz


 

Making a Warranty Claim

Please send an email to: sales@envirotools.co.nz. Your email must include your full name, address, contact phone number, and a receipt or proof of purchase. Please state which product is faulty and describe in detail the specific fault you have encountered. Please include as much information as you can so we can process your claim as quickly as possible.

IMPORTANT: Please indicate if you would like a replacement, or a refund.

Return of Faulty Product

When we process your warranty claim you will be advised whether or not we require the faulty product to be returned. Our decision will depend on the product and nature of the fault. Our decision is not influenced by your choice of a replacement or a refund.

You must cover the costs of shipping your product back to us. See ‘6. Shipping’ for specific information and details.

Replacement of Faulty Product

If you have chosen a replacement, we will send you a new product of the same model.

If the product model has been superseded by an equivalent product, we will send the equivalent product. If the product model is no longer available and has no replacement, we will provide you a refund of the original purchase value of the product.

If we have requested you to send the faulty product back to us, we will not send you your replacement product until we have first received the faulty product. You are not required to pay for shipping the replacement product to you. Please See ‘6. Shipping’ for specific information and conditions.

Refund of Faulty Product

If you have chosen a refund, we will provide a refund of the original purchase value of the product. We will send you a confirmation email notifying that your refund will be processed.

If we have requested you to send the faulty product back to us, we will not process your refund until we have first received the faulty product. See ‘7. Refunds’ for further information.

  1. RETURN POLICY

Terms of Return Policy

Our return policy lasts for 7 days from the date when you receive your order.

A return entitles you to either:

  • an exchange with another product of the same value, or,
  • a refund of the purchase price.

Conditions:

  • The product must be returned unused and in the original condition and packaging in which you received it.
  • You must notify us within 7 days of receipt of your order by sending an email to: sales@envirotools.co.nz Please include your full name, address, contact phone number, receipt or proof of purchase, and specify the product that you would like to return.

 

Return of Product

If your return is approved, we will send you a confirmation email and request you to return the product to us. Please do not return a product until you have received confirmation as it may be difficult for us to trace its origin, and introduce delays processing your exchange or refund.

You must cover the costs of shipping your product back to us. See ‘6. Shipping’ for specific information and details.

Refund of Product

If approved, we will provide a refund of the original purchase value of the product. We will send you a confirmation email notifying that your refund will be processed.

We will not process your refund until we have first received your returned product. See ‘7. Refunds’ for further information.

Credit for Exchange of Product

If approved, we will provide a credit of the original purchase value of the product – excluding shipping costs.

We will not process your credit until we have first received your returned product.

Your credit can be used to purchase another product of the same or greater value. Any balance, including new shipping costs, are required to be paid by you before shipment.

  1. ORDER ERRORS

If you receive a product from us which is not the one you ordered, you may choose either:

  • a replacement of the incorrect product with the correct product, or,
  • a refund of the amount you paid for the unreceived product.

Conditions:

  • Any incorrect product must be returned unused and in the original condition and packaging in which you received it.
  • You must notify us within 7 days from receipt of the incorrect product by sending an email to: sales@envirotools.co.nz. Please include your full name, address, contact phone number, receipt or proof of purchase, and describe the incorrect product you have received.

IMPORTANT: Please indicate if you would like a replacement, or a refund.

Replacement

If you have chosen a replacement, we will send you the correct product including a self-addressed return ticket for you to send the incorrect product back to us. See ‘6. Shipping’ for specific information and conditions.

Refund

If you have chosen a refund, we will send you a self-addressed return package for you to send the incorrect product back to us. See ‘6. Shipping’ for specific information and conditions.

Once we receive the incorrect product, we will send you a confirmation email notifying that your refund will be processed. See ‘7. Refunds’ for further information.

  1. SHIPPING

Costs and Options

Unless otherwise stated, shipping costs are additional to the cost of products for all new orders.

Shipping costs are calculated either by the total physical weight, or total volumetric weight of your order including packaging – whichever is greater. We always endeavour to minimize parcel sizes.

Courier:

  • Typically used for orders up to 25Kg physical weight.
  • Quoted shipping costs are calculated using a New Zealand CourierPost Standard courier service for the North Island, and an Economy courier service for the South Island.
  • Costs exclude Signature Required or Saturday Delivery options. If these are required, please contact us prior to placing your order and we will provide you with revised pricing.
  • If an alternative carrier is preferred, please contact us prior to placing your order and we will advise if we can accommodate.

Standard road transport:

  • Typically used for orders over 25Kg physical weight.
  • Quoted shipping costs are calculated using the Mainfreight nationwide shipping service.
  • If an alternative carrier is preferred, please contact us prior to placing your order and we will advise if we can accommodate.

Collection:

  • Orders may be collected from our warehouse in Petone, Lower Hutt by prior arrangement only. If wishing to collect, please first contact us at: sales@envirotools.co.nz
  • Order collection does not incur any cost.

Multiple Shipments

Quoted shipping costs are calculated assuming a single shipment to a single address. If multiple shipments are required; either staggered to a single address, or a split shipment to multiple addresses; please contact us prior to placing your order and we will provide you with revised pricing.

When a single order is delivered in multiple shipments due to stock availability, we will cover any additional shipping costs incurred.


 

Delivery Times

Orders are shipped from our facility in Petone, Lower Hutt everyday Monday-Friday, except on Public Holidays.

Normally orders received before 12pm are shipped by 5pm the same day. Orders received after 12pm are shipped the following day by 5pm. Orders placed over weekends or on public holidays are shipped by 5pm on the next available business day.

Delivery times vary depending on the destination address and shipping carrier used. While we make every effort to dispatch your order in a timely manner, we are not liable for any loss or damage arising in any way from delay in delivery.

Once your order has been dispatched, you will receive your tracking number/consignment number via email.

IMPORTANT: We are unable to deliver orders to a PO Box Address. If you have provided a PO Box Address, we will contact you requesting a physical address for your order to be shipped to.

Warranty Replacements

You are responsible for all costs to return a faulty product to us. This includes any packaging and associated logistics costs. You should consider using a trackable shipping service or purchasing shipping insurance. We do not guarantee that we will receive your returned item.

We will cover shipping costs free of charge for any outgoing warranty replacement product.

Returns Policy

Order Errors

We will cover all shipping costs for incorrect products.

We will send you the correct product including a self-addressed return ticket and packaging for you to send the incorrect product back to us.

Any additional packaging consumables such as adhesive tape, and associated logistics costs are your responsibility.


Return Shipments

Under the terms of our warranty and returns policy, you may be required to return your product to us. When required, please return by delivering to:

Shipping Liabilities

Our shipments

This includes all shipments we send to you, and any return shipments we are responsible for.

Any damage which has occurred to our shipments is the legal responsibility of the freight provider. We undertake responsibility to lodge an insurance claim with the freight provider on your behalf.

It is your responsibility to notify us as soon as possible of any undelivered shipment or damages incurred to any product within a shipment. Any delay may void the legal responsibility of the freight provider.

All responsibility for replacement or refunds are with the freight provider and determined at the conclusion of the insurance claim.

Your shipments

This includes any return shipments you are responsible for.

In the event a shipment you are responsible for has failed to be delivered to us, it is your full responsibility to lodge an insurance claim with your shipping provider.

In the event damage has occurred to your shipment whilst in transit to us, we reserve the right to reject a replacement or refund. In this instance it is your full responsibility to lodge an insurance claim with your shipping provider. We will provide you with any necessary evidence as required to support your insurance claim. 


 

  1. REFUNDS

Once your returned product is received and accepted by us, we will send you a confirmation email notifying that your refund will be processed. A credit will automatically be applied to your credit card or original method of payment.

If you have returned a product to us which is not eligible under our Warranty or Return Policy conditions, you will not receive a refund.

If you wish to have your product returned to you, then you will need to cover any applicable shipping costs.

If you do not wish to receive your product back or have not made contact within 30 days of receiving an email notification from us, your returned product will be broken down and recycled.

Excluded from Refunds

Only the original purchase price of the product is refundable.

Shipping costs are non-refundable. If you receive a refund, the original cost of shipping the product to you will be deducted.

Any adjustments, modifications or damages to property, or other costs incurred to install our product are not refundable.

Late or Missing Refunds

If you have not received a refund following notification, please first check your bank account again.

Next, we kindly ask that you contact your bank and/or credit card company. There is often some processing time before a refund is officially posted.
